These Terms of Service ("Terms") govern your access to and use of the website and services provided by dataplexium B.V., a company incorporated in the Netherlands with registration number 69382057 ("dataplexium", "we", "our", or "us").
Acceptance of Terms
By accessing our website at dataplexium.pro, engaging our data analytics services, or otherwise interacting with dataplexium, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use our website or services.
These Terms constitute a legally binding agreement between you and dataplexium B.V. Your continued use of our services after any modifications to these Terms will constitute acceptance of such changes.

dataplexium provides professional data analytics services including but not limited to:
- Machine learning and artificial intelligence solutions
- Business intelligence and dashboard development
- Data integration and ETL services
- Data strategy consulting and advisory services
- Predictive analytics and statistical modelling
- Custom analytics solutions and implementations
Specific terms for professional services will be outlined in separate service agreements or statements of work executed between dataplexium and the client.
User Obligations
When using our website and services, you agree to:
Acceptable Use
- Use our services only for lawful purposes and in accordance with these Terms
- Provide accurate, current, and complete information when requested
- Maintain the confidentiality of any account credentials or access information

Subject to these Terms, dataplexium grants you a limited, non-exclusive, non-transferable licence to access and use our website for its intended purpose. This licence does not permit you to copy, modify, distribute, sell, or lease any part of our services or content.
Client Data and Deliverables
While you retain ownership of your data provided to dataplexium, any analytical models, methodologies, insights, or deliverables created by dataplexium in the course of providing services may contain dataplexium intellectual property. Specific ownership and licensing terms will be defined in individual service agreements.
Payment Terms
For professional services:
- Payment terms will be specified in individual service agreements
- All fees are exclusive of applicable taxes unless otherwise stated
- Late payment may result in suspension of services and additional charges
- Disputed invoices must be raised within 30 days of receipt
Confidentiality
dataplexium acknowledges that in the course of providing services, we may have access to confidential information belonging to our clients. We commit to maintaining the confidentiality of such information and will not disclose it to third parties except as required by law or with explicit client consent. Detailed confidentiality terms will be included in service agreements.
Data Protection and Privacy
Our collection, use, and protection of personal data is governed by our Privacy Policy, which forms part of these Terms. We are committed to compliance with the General Data Protection Regulation (GDPR) and other applicable data protection laws. By using our services, you consent to our data practices as described in our Privacy Policy.
Limitation of Liability
To the maximum extent permitted by Dutch law, dataplexium's total liability to you for any claims arising out of or relating to these Terms or our services, whether in contract, tort, or otherwise, shall not exceed the total amount paid by you to dataplexium in the twelve (12) months preceding the event giving rise to the claim.
In no event shall dataplexium be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.
Service Disclaimers
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure. While we strive for accuracy in our analytics and recommendations, we cannot guarantee specific business outcomes or results.
Indemnification
You agree to indemnify, defend, and hold harmless dataplexium, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your use of our services, your violation of these Terms, or your infringement of any rights of another party.
Termination
Either party may terminate these Terms at any time by providing written notice. dataplexium reserves the right to suspend or terminate your access to our services immediately, without prior notice, if you breach these Terms or engage in any conduct that we reasonably believe is harmful to our business, other users, or third parties.
Upon termination, your right to access and use our services will cease immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect, including but not limited to intellectual property rights, limitation of liability, and governing law provisions.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands.
If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights as a consumer under applicable consumer protection laws.
Changes to Terms
dataplexium reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, such provision will be modified to the minimum extent necessary to make it enforceable, and the remainder of these Terms will remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and any applicable service agreements, constitute the entire agreement between you and dataplexium regarding the use of our services and supersede all prior or contemporaneous understandings and agreements, whether written or oral.
